Noah Gaston indicted on manslaughter and murder charges for shooting wife

A Cumberland County Grand Jury has indicted Noah Gaston of Windham on murder and manslaughter charges in the shooting of his wife.

(NEWS CENTER) -- A Cumberland County Grand Jury has indicted Noah Gaston of Windham on murder and manslaughter charges in the shooting of his wife on Friday, according to the Attorney General's office.

Gaston, 33, told police before his arrest that he accidentally killed his wife, Alicia Gaston, on Jan. 14 with a single shot from a shotgun in the stairwell of their home after mistaking her for an intruder

Police charged Gaston with murder. Police said there were inconsistencies in his statements and his 8-year-old daughter, who was home at the time of the shooting, told police that she heard her parents fighting that morning.

However, a judge questioned the charge of intentional murder. In February, the judge said that the daughter's recorded statement to police did not indicate that her parents had been fighting. In that same hearing the judge decided to hold Gaston without bail.

Ultimately, the indictment decision was presented to a Cumberland County Grand Jury on Friday, which ruled that Gaston be indicted for manslaughter and murder.
