Subpoena approval into Marissa Kennedy's death drops barrier to information

Even with authorization granted to release information, some names and details surrounding the death investigation of Marissa Kennedy may be withheld while the case remains active

AUGUSTA (NEWS CENTER Maine) -- The Legislature's Government Oversight Committee voted to issue subpoenas for information about the death of ten-year-old Marissa Kennedy.

Two weeks ago, the committee ordered an investigation by the OPEGA agency to find out if DHHS, local police and local schools could have done more to protect the girl. The OPEGA director said Friday the schools face confidentiality requirements under federal law, and need subpoenas to be able to release the information on the case.

Marissa was only 10-years-old when she died.

Investigators are still gathering documents and will be working with the Maine Attorney General to handle other confidentiality issues related to the case. OPEGA director Beth Ashcroft said there will likely be some names and details that will not be made public until the criminal cases are resolved.
